English version
1. Operator, scope and language
The HR EXTERMINATION application is operated by 9560-8576 QUÉBEC INC., doing business as HR EXTERMINATION. Business/privacy contact: info@hrextermination.ca. Subject to assigned access, it manages requests, quotes, visits, reports, files, invoices, recorded payments and follow-ups. It is not a public software-selling service or an emergency service.
French terms must be supplied or made available as applicable before requesting adherence in another language. Using an English interface is not, by itself, an express choice to contract exclusively in English. No language-precedence provision removes mandatory consumer or adhering-party rights.
2. Accounts and access
Use your own identity or act with valid authority. Owners, landlords, property managers and representatives must have authority to request work and supply property information. Creating a Google or Clerk identity does not automatically give employee, business-owner or customer-record access. Business permissions are assigned in the company's database.
Protect login methods, do not share accounts, and report suspected misuse promptly. Accessing others' records, bypassing controls, introducing malware, abusively extracting records or disrupting service is prohibited. We may restrict access to protect people/systems while preserving legal information-access and document rights. Closing portal access does not cancel a service contract or valid debt.
3. Requests, prices and contracts
An inquiry or appointment request alone does not confirm service, final price or availability. Booking functions may be disabled. Before commitment, the applicable quote/agreement must identify services, location, price/taxes, included visits, deposit/payment terms, exclusions and relevant cancellation conditions.
Where distance-contract law applies, the process must supply required information before commitment, permit error correction and acceptance/refusal, and deliver a contract copy within the legal deadline. An internally retained copy or “sent” status does not establish email delivery. The reviewed software has no automatic business email/SMS delivery.
Electronic acceptance and the entered signatory name may evidence agreement to a retained document version. Identity, authority and relevant circumstances still require consideration; merely viewing a page is not presented as signing. A post-acceptance scope/price change requires a clearly accepted revision, not altered history.
4. Service delivery and safety
Provide accurate information and authorized, safe access. Identify relevant safety constraints, such as occupants requiring protection, animals, restricted areas or known contamination, without unnecessary personal details. Follow the visit-specific preparation, evacuation, re-entry, ventilation and follow-up instructions. Do not move or handle devices/products contrary to instructions.
Methods depend on inspection, pest, property conditions, legal rules and product directions. A visit does not guarantee permanent freedom from pests. Any commercial retreatment/follow-up warranty must be stated in the agreement without limiting statutory protections. HR EXTERMINATION may postpone work because of risk, inadequate access or legal restrictions and must explain next steps and applicable contractual effects. These terms do not create undisclosed attendance/cancellation fees.
A report records work and findings; it is not a structural assessment, medical diagnosis or guarantee of whole-building compliance. If a person is in immediate danger, contact emergency services rather than awaiting a portal response.
5. Invoices, deposits, cancellation and refunds
Payment dates and deposits are those in the accepted agreement. A payment entry is an administrative record, not itself a bank debit, card charge or refund. The reviewed configuration does not process online cards. Report invoice/balance discrepancies and retain payment evidence.
These general terms impose no late fee, interest rate, non-refundable deposit, automatic renewal or cancellation penalty. Any such proposal must be lawful, clearly disclosed and accepted in the relevant agreement. Mandatory cancellation, termination, refund and chargeback rights remain unaffected. Withdrawing privacy consent does not automatically cancel a service contract, or vice versa.
6. Files, photos and documents
The Railway-hosted application must not be used to intentionally collect or store sensitive or special-category personal information. Necessary customer contact details, service addresses, pest/service history, invoices, ordinary notes and ordinary relevant treatment/property photographs remain permitted. Do not submit unnecessary medical information, government IDs, banking/card credentials, passwords, security credentials, access codes, intimate information unrelated to pest control, unnecessarily revealing private photographs or other information sensitive by context. Review notes and files, crop or redact unnecessary details before sending, or omit the file. If sensitive information seems necessary, consult the privacy lead before entering it; consultation does not create an exception allowing storage in this application.
Upload only relevant content you are authorized to supply. Avoid unnecessary identity documents, card data, medical records and third-party images. You retain your rights in submitted content and permit only uses needed for service, documentation, security, backup and applicable obligations; no advertising licence or content sale is granted.
You may use company documents for service-related needs and legal rights. Do not alter them to create misleading evidence or disclose others' information. Intellectual-property rights do not prevent lawful claims, access requests or permitted disclosures.
7. Operation, third parties and privacy
Internet access and a compatible device may be needed. Drafts and queued uploads are not guaranteed synchronized: verify saving before changing devices or clearing local storage. Outages, maintenance or provider issues may interrupt the portal; contact the business for service needs. Continuous availability and round-the-clock monitoring are not promised.
The Privacy Policy explains authentication, providers, local copies and address transmission when using Google Maps. External services have their own terms; an optional service is not made mandatory for an unnecessary purpose. Marketing consent is not a general service condition. Future commercial electronic communications must meet applicable consent, sender-identification and unsubscribe requirements.
8. Responsibility and remedies
Each party remains responsible under applicable law. Nothing excludes liability for intentional/gross fault, bodily/moral injury, or a non-waivable guarantee or remedy. These terms impose no uniform liability cap, mandatory arbitration, class-action waiver or broad customer indemnity.
Contact info@hrextermination.ca for complaints/corrections. Quebec law and applicable federal law govern without depriving a person of mandatory protections in their jurisdiction. Competent courts and statutory administrative remedies remain available; no exclusive forum reduces consumer rights.
9. Changes and specific agreements
Future changes are clearly presented with notice/consent where required and do not retroactively modify an accepted quote or service record. A lawful specific service-agreement provision governs its subject, subject to mandatory law. Invalidity of a provision does not automatically invalidate the rest or allow essential customer rights to be rewritten. Revised policies/contact details must remain available in French and English.
